Analyzing to the Central Administrative Body’s Organization Fundamental Act

中央行政機關組織基準法（以下簡稱組織基準法）是我國中央行政機關改造之基本法，其所規範之內容，不僅為行政法之範疇，同時也是屬於行政學之範圍。亦即是，屬於行政法與行政學兩者之間的交錯地帶。對於組織基準法之析解，本文係從組織基準法之立法過程之梗概先予論述，繼而就其內容予以析解評述。析解評述之主要內容計有組織基準法與憲法增修條文第三條第三項之關係，組織基準法與中央法規標準法之關係，機關組織法規及名稱之研析，行政組織權之研探等項，其中行政組織權之研探尚包括機關設立、調整與裁撤等等細項。至於對組織基準法所為之析解評述，主要係以行政法中之行政組織法之理論與行政學中之組織理論、組織結構為析解之理論基礎。

The Central Administrative Body’s Organization Fundamental Act (shorten to the Organization Fundamental Act) is considered as essential regulations for our central administrative body to reform its organization. The Organization Fundamental Act not only contains the scope of administrative law but also public administration. In other words, its contents are both of administrative law and public administration.
It would be written remarks giving some argumentation on legislative procedure further to analyze or criticize the Organization Fundamental Act in this essay. The majority comments that criticize to the relations between the Organization Fundamental Act and article III paragraph III in the Amendment of the Constitution as well as the Central Legislative Standard Act. In addition, regulations and name of administrative organization and the administrative organization authority are also studied and criticized. Especially, to establish, adjust or abolish on administrative body, etc.
However, theory of administrative organization laws of administrative law, and organization theory and structure of public administration those are analyzed basically for the Organization Fundamental Act.
