從實質刑法典到形式刑法典：刑法的進階之路

From the Substantive Criminal Code to the Formal Criminal Code: The Progressive Path of Criminal Law

刑法的再法典化是我國當前刑法學界關注的一個重要問題，它與刑法的立法完善密切相關。我國目前的刑法本身已經是一部實質意義上的刑法典，尤其是立法機關按照統一刑法典打造刑法的立法方式，為我國刑法的法典化奠定了基礎。因此，刑法的法典化不同於其他部門法的法典化，其建立在實質刑法典的基礎上，所要進行的是再法典化。通過刑法的再法典化，完成從實質刑法典到形式刑法典的進階。在刑法的再法典化過程中，應當正確處理一元立法體制與多元立法體制、罪名分類與章節設置、罪狀表述的精細與粗疏等問題，進一步貫徹罪刑法定原則，利用刑法的再法典化的契機，較大幅度地提升我國刑法典的立法水平。

The recodification of criminal law is an important issue of concern to the criminal law scholars in China, and it is closely related to the legislative improvement of criminal law. China􀆶s current criminal law itself is already a criminal code in the substantive sense, especially in the legislative orientation of the legislature to create a criminal law in accordance with the unified criminal code, which has laid the foundation for the codification of China􀆶s criminal law. Therefore, the codification of criminal law is completely different from the codification of other branches of law, it is a recodification based on the substantive criminal code. Through the recodification of the criminal law, the progress from the substantive criminal code to the formal criminal code has been completed. In the process of recodifying the criminal law, it is necessary to correctly handle issues such as the unitary legislative system and the pluralistic legislative system, the classification of crimes and the setting of chapters, and the fineness and sparseness of the expression of crimes, further implementing the principle of legality of crimes, and taking advantage of the opportunity of the recodification of the criminal law to greatly improve the legislative level of China􀆶s criminal code.
