The Apostille Convention, one of the most successful international treaties under the auspices of the Hague Conference on Private International Law, has greatly simplified the process of authenticating public documents worldwide. The core mechanism of the Convention being the Apostille, which is a mechanism innovation that replaces consular authentication and has proof of validity. At present, China has acceded to the Apostille Convention, in order to effectively promote the implementation of the Apostille, China is faced with a series of problems, how to supplement its rules, how to interface with our legal system and how to be compatible with other relevant treaties. Based on the content of the Convention and China's conditions, China should change the name of the Consular Authentication Measures to the Measures for the Certification of Documents, and add a special chapter on Apostille to interface with domestic laws and supplement the Apostille, and achieve compatibility with relevant treaties in China through interpretation of treaties and Article 3 of the Convention. |
