This article provides a selective examination of significant legal developments and practical insights related to criminal law in 2022. It covers a range of issues, including the introduction of legislation to establish Internet gambling as a criminal offense, the repeal of the provision of insulting the public office, and the increase in criminal liability for insulting civil servants. The article also tracks the progress of the Harassment Prevention Act, and discusses constitutional court decisions on the retroactive application of confiscation of criminal proceeds. Furthermore, it analyzes a significant criminal court ruling on whether fraudulent syndicated riders should be considered as money laundering offenses. From a legislative perspective, the criminalization of Internet gambling and the measures to combat stalking reflect the evolving needs of society in terms of penal control. The practical problems relating to confiscation of proceeds of crime and money laundering arise from previous systemic changes in criminal law, which were already controversial. Overall, the legislative rationales or practical insights are plagued by issues of inadequate reasoning and gaps in the logic. |
