論中國自主法學知識體系的建構

On the Construction of China̓s Independent Legal Knowledge System

建構中國自主法學知識體系旨在增強新時代中國法學知識體系的自主性。從建構方法、建構策略、建構路徑的角度來說，應當著眼于深化馬克思主義法學理論的中國化表達、推動中華優秀傳統法律文化的時代化再造、改進中國當代法治實踐的理論化提煉、加強外來法學知識的選擇性借鑒。這四個方面，分別針對中國自主法學知識體系與馬克思主義法學理論的關係、中國自主法學知識體系與中華優秀傳統法律文化的關係、中國自主法學知識體系與中國當代法治實踐的關係、中國自主法學知識體系與外來法學知識的關係。四個相互關聯的維度合力促成中國自主法學知識體系的建構。

The construction of China’s independent legal knowledge system mainly aims to enhance the autonomy of China’s legal knowledge system in the new era. From the perspective of construction methods, construction strategies and construction paths, the construction of China’s independent legal knowledge system should focus on deepening the Chinese expression of Marxist legal theory, promoting the modernization of China’s excellent traditional legal culture, improving the theoretical refinement of China’s contemporary legal practice, and strengthening the selective reference of foreign legal knowledge. These four aspects are respectively aimed at the relationship between China’s independent legal knowledge system and Marxist legal theory, the relationship between China’s independent legal knowledge system and China̓ s excellent traditional legal culture, the relationship between China’s independent legal knowledge system and China’s contemporary legal practice, and the relationship between China’s independent legal knowledge system and foreign legal knowledge, which can help promote the construction of China’s independent legal knowledge system from four interrelated dimensions.
