Research is a systematic method to acquire novel and reliable knowledge, which means that research must be conducted using widely accepted research methods and steps that are accepted by the academia. Legal research is no exception, it is an intellectually creative activity conducted under a systematic and disciplined method in order to obtain novel and reliable legal knowledge. Jurisprudence is a humanistic study, thereby legal research should take human as its logical beginning, construct the “model of the human” and conceptualize the core assumption of “legal person” to research legal issues arising from human behaviors. In terms of research aims, legal research first emphasizes the novelty of legal knowledge, which means the new knowledge generated through legal research could occupy the theoretical high ground, fill in the knowledge gaps and deepen debates; second, legal research also emphasizes the reliability of legal knowledge, namely that the new knowledge can be well and solidly argued. Testing the truthfulness of legal research conclusions can be done using theoretical, factual, normative and logical test methods. |
