China's Arbitration Law is about to be substantially revised for the first time since its enactment. The (Revised) Arbitration Law (Draft for Comments) released by the Ministry of Justice not only makes significant modifications to the deficiencies of the current Arbitration Law, but also makes a beneficial attempt to accommodate investment arbitration system. With the deepening of China's Belt and Road Initiative and the increase of investment arbitration cases involving Chinese government and investors, how to provide an appropriate legal framework has become the realistic demand of China. Therefore, the Consultation Draft and relevant regulations should focus on ensuring the arbitrability of investn1ent disputes, contemplating internal appeal mechanism, and facilitating the recognition and enforcement of investment arbitral awards, so as to guarantee the smooth development and good operation of investment arbitration in China in the future. |
