Research on the Subjects Application Scope of SOEs Chapter under CPTPP, Its Impact on China and Our Countermeasures

伴隨著中國正式申請加入CPTPP，研究該協定項下的國企章節對中國的影響具有了現實而緊迫的意義。CPTPP國企章節設置了國有企業、指定壟斷、主權財富基金和獨立養老基金這幾類主體，在具體規則設定上表現出務實性和前瞻性。結合中國相關主體的現狀和動態發展來看，這些規則對中國具有制約和促進的雙重影響。對此，中國首先應在堅持“以我為主”的前提下，合理地將外部規則的壓力轉化為國內改革的推動力。其次應深化例外規則研究，為將來的談判做好充分準備。最後，考慮到國有企業規則在新一輪國際經貿規則重構中的重要性，中國應始終加强國有企業規制的理論構建。

With China's formal application to join the CPTPP, it is of practical and urgent significance to study the impact of SOEs Chapter under the CPTPP on China. The SOEs Chapter sets up four types of obligation subjects, including the SOEs, the designated monopolies, the sovereign wealth funds and the independent pension funds. Combined with the current situation and development tread of the above-mentioned subjects in China, the rules under SOEs chapter of CPTPP have a dual impact of restriction and promotion on China. In this regard, firstly, China should reasonably transform the pressure of external rules into the driving force of domestic reform. Secondly, China should deepen the study of exceptions provided by the CPTPP and make full preparations for future negotiations. Finally, considering the importance of SOEs rules in the new round of reconstruction of international economic and trade rules, China should not give up the theoretical construction and confrontation of SOEs' regulation.
