習近平法治思想中的原創性人民話語－－基於馬克思主義經典理論的闡釋

The Original Discourse of the People in Xi Jinping Thought on the Rule of Law: An Interpretation Based on Marxist Classical Theory

習近平法治思想具有鮮明的人民性。以人民話語集中表達新時代中國特色社會主義法治話語，是習近平法治思想原創性理論貢獻的重要體現。“以人民為中心”是關於法治主體的原創性話語，其立足於馬克思主義關於人的創造性、現實性和社會性之人性論構建，深刻表達了人民的主體形象和主體地位。“人民的美好生活”是關於法治價值的原創性話語，體現了馬克思主義“人的全面發展”之終極價值追求，創造性地將人的價值與法治價值深度綁定。習近平法治思想人民話語的原創性亦有實踐維度，要求實現美好生活價值的權利轉化，促進法治內在公平正義價值的實踐性轉向，強調國家肩負更高階的積極義務。

Xi Jinping Thought on the Rule of Law has distinct people-centered characteristics. Concentration on expressing the discourse of socialist rule of law with Chinese characteristics for a New Era in the way of the discourse of the people is an important embodiment of the original theoretical contribution of Xi Jinping Thought on the Rule of Law. 'People-Centered' is an original discourse about the subject of the rule of law. This discourse profoundly expresses the subject image and subjectivity of the people, which is based on the Marxist classical theory on human nature of creativity, reality and sociality. 'People’s Good Life' is an original discourse about the value of the rule of law, which embodies the ultimate value pursuit of Marxist 'all-round development of human'. This discourse creatively binds human value with the value of rule of law. The original theoretical contribution of the discourse of the People in Xi Jinping Thought on the Rule of Law also has a practical dimension. It calls for transformation of 'Good Life' from value to rights, makes equity and justice value of law turns to be more practical, and emphasizes the positive obligations of the state at a higher level.
