Society of Environmental and Resources Law, China Law Society, Beijing 100081,China) Abstract: Categorization of environmental legal norms is a foundational task of environmental codification. Under the background of the “spillover effect” that the classification theory of general legal norms lacks explanatory capacity to the development practice of environmental legal norms, typological thinking, as the supplement of conceptual thinking, has characteristics of bidirectionality, openness and value dependence, which is methodologically beneficial to the construction of the normative system of environmental code. At the level of substantive rationality, typological thinking bridges sustainable development value and ecological-environment concept, achieving the substantive systematization of environmental code through constructing normative types of pollution control, natural ecological protection and green and low-carbon development. At the level of formal rationality, typological thinking provides formal identification standards for codification by describing the “overall image” of environmental legal norms, and reclassifies environmental legal norms so as to put forward the arrangement of legal norms for environmental codification. |
