論投資者—東道國爭端解決機制改革分歧的彌合進路

China’s Proposal for Multilateral Investor-State Dispute Settlement Reform: Assessment of Possibility of Bridging Differences

投資者—東道國爭端解決機制(ISDS)是近年來全球經濟治理的熱點問題。各國提出與實施的改革方案既有顯著分歧，也有相互借鑒。各種ISDS改革方案之間已經有著諸多相互借鑒的事實表明，在保留ISDS基礎上的妥協是大多數國家可以接受的選項。中國在UNCITRAL提出的改革方案是在維護現有投資仲裁機制的基礎上，設立基于條約的多邊常設上訴機制。中國方案介于堅持投資仲裁的改良派和主張投資法院的革命派之間，與兩者各有共鳴之處，與它們的分歧并非不可逾越的障礙，因此能夠成為彌合不同改革方案的基礎。

"The Investor-State Dispute Settlement( ISDS) is one of the most contentious issues in global economic governance in recent years.States have put forward or initiated different reform schemes which are learning from each other.Recommendations of China regarding ISDS reform is,based on the position that the ISDS is generally worth maintaining,the establishment of a multilateral permanent appeal mechanism grounded on international treaties.China’s proposal follows the middle path between the scheme of improving the investment arbitration and the revolutionary one of investment court system.Since Chinas’proposal is sharing commonalities with both schemes,respectively,and the differences with them are not insurmountable,Chinas’proposal may form the basis of bridging different ISDS reform schemes."
