"The informed consent is the basic requirement and a core norm for the protection of personal information. Both the ''explicit'' requirement and the sufficiency requirement in the notification rule imply the obligation of explanation. In the case of automated decision - making using algorithms, personal information processors should also undertake a corresponding ''algorithm explanation obligation''. The algorithm explanation obligation is theoretically justified. In addition to sharing the justifications of the explanation obligation of the personal information processor, it has a number of additional reasons for reinforcement, but it also faces some conflicting reasons, which interact and determine the limit of the algorithm explanation obligation. The purpose of the algorithm explanation obligation is to safeguard personal awareness. What needs to be explained is useful information about the algorithm technology and its application, but there is no need to provide the technical details and complex mathematical explanations of the algorithm. In order to make up for the insufficiency of the algorithm' s explanation, it can be supplemented by the algorithmic accountability system thus to coordinately regulate the algorithm." |
