從思想史來看，人權先後呈現出天賦以及反天賦論兩重面孔，人權概念也呈現出道德概念和政治概念的大體區別。但歷史上的兩種主張都是建立在虛假的二元對立之上且很難有充足說服力的。只有實踐唯物主義視域下的人權概念才是其該當的正解。新的時代，人權的理解和踐行也該當進行相應的實踐轉向。
