"為了使學術不受到國家的任意干擾,賦予大學享有自治的權限,但是,自治不代表不受任何拘束。因此,憲法第162條授權國家得以法律監督大學自治。其中,大學法第5條第2項的規定讓教育部得對大學進行評鑑。雖然大學評鑑的實施,能夠讓大學明白其問題的所在,並因而達到評鑑乃是為了追求學術的目的。然而,不可否認地,大學評鑑與大學自治之間有一緊張關係。所以,本文透過大學自治與大學評鑑關係的釐清、大學評鑑制度的檢討,以檢討我國的大學評鑑法制。簡單來說,本文的主要目的即在於調和大學自治與大學評鑑的衝突關係,並為我國的大學評鑑法制,提供改善的建議。In order to prevent the academic development from arbitrarily governmental interference, it is well settled that universities enjoy the right of autonomy. However, to say universities enjoy the right of autonomy does not implicit that universities are free from restrictions. It is for this very reason that Article 162 of the Constitution empowers the state to prescribe law to supervise university autonomy. Of all relevant laws, Article 5, Paragraph 2, of the University Act authorizes the Ministry of Education to accredit universities. Although the implementation of university accreditation is to enable the individual universities to discover its deficiencies and is with a view to further the purpose of academic improvement, there is a perceived tension between university accreditation and university autonomy. Accordingly, this Article will conduct a critical analysis of the university accreditation in Taiwan via the clarification of the relationship between university autonomy and university accreditation and via the review of current university accreditation system. In short, the primary purpose of this Article is to harmonize the conflicted relationship between university accreditation and university autonomy and to provide some reform suggestions for improving the legal regime of university accreditation." |
