非洲有悠久的仲裁歷史傳統，隨著非洲仲裁市場的日趨成熟，涉及非洲國家的仲裁案件明顯增多。為了營造一個更加穩定、可靠、有利于仲裁蓬勃發展的環境，非洲許多國家和地區制定了現代化仲裁法，以建立完整的仲裁體系并使仲裁裁決有效執行，同時設立了許多高水平的仲裁機構，以提高該地區仲裁機構的國際影響力。目前，非洲的仲裁環境正在改善，但要成為當事人解決涉非糾紛的首選，非洲仲裁的發展仍任重道遠。
