Civil servants' Administrative Neutrality Act in Taiwan was formed and implemented on June 10, 2009. The Administrative Neutrality Act mostly applies to applicable personnel under the Article 2, while mutatis mutandis of the Administrative Neutrality Act applies to personnel listed in Article 17 and Article 18. For example, various authorities and guard police in public schools, the full-time staffs and presidents of water resources agency are all applied to the regulations under the mutatis mutandis of the Administrative Neutrality Act and abided by the obligation of administrative neutrality.
When discussing the civil servant under the regulations of Administrative Neutrality Act, the article is divided the civil servant into two categories: ''applicable personnel'' and '' mutatis mutandis personnel''. The article specifically introduces and analyzes these two categories of civil servant in detail, and explores the background and reasons why these civil servants are included in the regulation from the history of Administrative Neutrality Act. Secondly, it is necessary to review and analyze the unclear language used or any deficiencies for the above-mentioned civil servant. Finally, the article suggests the revision of laws and regulations on the civil servant under the regulations of Administrative Neutrality Act. The suggestions can be a future reference for the revision of the theory and its legal practice of administrative neutrality of civil servant. |
