數位典藏素材授權之問題研究

數位典藏除了保存功能，亦重視數位化內容的加值應用，但前段的典藏準備工作及後段的加值應用皆牽涉到「授權利用」的問題，對典藏者而言，在前段蒐集素材過程，其屬被授權者的角色，但後段的加值應用階段，身為數位化素材的輸出者，典藏者搖身一變成為授權者。在典藏素材的授權事宜上，因被授權者與授權者身分的差異，各有不同的關切面向。因此本文擬從應用的角度，以典藏者立場為中心，思索、探究進行原始素材及數位化素材授權事宜時，所可能面臨之法律問題及因應之道。希冀這些實用資訊，除可保障典藏者自己的權益，亦有利數位典藏加值應用之順利推展。

The goal of digital archives includes the preservation and value-added use of digital content. It respectively involves the important license issue while engaging in the collection and value-added use of digital content. In general, the holder of digital archives plays the role as a licensee in the stage of collecting raw materials, and works as a licensor of digital content. It is obvious that a licensee's major care is different from what a licensor concerns. Hence, from the perspective of the holder, this article tries to explore the possible legal problems and their solutions during licensed and licensing processes for the purpose of promoting the value-added use of digital archives.
