A Study on the Right of Access to Archives

本文從檔案法與政府資訊公開法之競合談起，探討檔案應用請求權之法律依據及其性質，並從權利主體、義務機關、權利客體及收費標準四方面，闡明檔案應用請求權之內涵及其限制，進而說明此項權利之行使方式及救濟途徑，係屬有關檔案應用實務概論性之文章，可供檔案管理人員參考。

This article begins with the discussion of the concurrency between Archives Act and Freedom of Information Act. It studies the legal basis and the nature of the right of access to archives, and clarifies the content and the limitation of the right in four aspects that are subject of right, agency of obligation, object of right and fee standard. Furthermore, it explains the execution of the right and the remedies. It is a paper of general discussion about the practical affairs of access to archives, which can be a good reference for archives management staffs.
