檔案銷毀相關法律問題探析

A Study on the Legal Issues of Archives Destruction

檔案法及相關子法之頒布施行，不僅為我國檔案管理制度奠定法制基礎，更使機關檔案之建制與管理，成為各機關業務推展的重要工作之一，其中如何兼顧檔案之保存維護與開放應用，厥為制度規劃與實作執行之重心所在，而一套完善之檔案銷毀制度，尤為檔案建制不容忽視的一環，蓋銷毀與保存為檔案管理之一體二面，互為表裡，缺一不可。緣此本文從法律之觀點，嘗試探討檔案銷毀之相關問題，首先介紹檔案銷毀之關聯制度，如檔案保存年限之判定、檔案保存年限之區分等；其次，說明檔案銷毀之原因與要件；再者，論析檔案銷毀之程序與方式；繼則，簡述違法銷毀檔案之處理與罰則；最後，探討檔案銷毀在行政爭訟法上之若干議題，期供法規適用與研修之參考。

Based on the viewpoints of administrative law, this article deals with the legal issues of the archives destruction. It is divided into five sections. First, it introduces the correlative mechanisms of the archives destruction, e.g. decision of the archives retention period. Secondly, it seeks to analyze the reasons and conditions of archives destruction. Thirdly, it discusses the destroying procedures and the methods of the archives destruction. Fourthly, it explores the sanctions against the illegal archives destruction. Finally, it focuses on some problems in the administrative proceedings, and offers some personal opinions for interpretation and amendment of the laws and rules.
