臺灣專利侵權訴訟之實務現況：崩壞與亟待重生的智慧財產生態系統（Ecosystem）

臺灣成立智慧財產法院逾十年，專利侵權案件應為該法院核心業務。學者雖非直接進入法院利用該訴訟程序與制度，惟學術界乃立於中立角色觀察實務現況。在驗證法律規定落實於司法實務之缺失及提出具體檢討建議前，宜先檢視智慧財產法院之專利侵權訴訟運作，瞭解其是否符合原先設立此「專責」法院之立法目的、智慧財產案件審理法之宗旨與目標是否達成。本文檢視2014年至2018年間智慧財產法院判決，對於專利侵權訴訟實務現況之結論為：崩壞與亟待重生的智慧財產生態體系（Ecosystem）。
