公平會高通公司處分案之簡評與省思

A Commentary on Qualcomm Antitrust Case in Taiwan

二○一七年十月公平會認定高通公司在智慧型手機晶片市場有濫用獨占地位行為，因違反公平交易法而重罰新臺幣兩百三十四億元，創下公平會最高罰鍰紀錄。本文先簡介標準必要專利權行使之爭議及相關競爭法規範問題、競爭法與智慧財產權之交錯議題，繼而簡評公平會高通公司處分案。

In October 2017, Taiwan Fair Trade Commission imposed a record fine of NT$23.4bn on Qualcomm Incorporated, accusing it of abusing its dominant market position over certain key mobile phone chips and violating the antitrust rules. This article introduces briefly the debats over enforcement of standard essential patent (SEP), the relevant antitrust issues, and the interaction between competition law and intellectual property rights. Also, a commentary on this controversial antitrust in Taiwan is covered.
