網路詐欺與消費者保護之刑法問題

詐欺罪進入網路時代後，不但仍然存在，網路交易所產生的詐欺現象，更是屢見不鮮，而且與消費者保護產生連動。本文首先解析消費者保護與刑法的角色，說明我國消費者保護法，並無刑法規定，只有在食安、藥安或公平交易等規定中，又附帶保護消費者的刑罰規定；相對來說，日本消費者交易相關保護法制上，刑罰規定發揮較大的功能，且有其一定的重要性，這一點似乎可作為我國借鏡。再就網路上的詐欺行為，分為網路交易詐騙與網路支付詐騙二大類來說明，分別說明各種犯罪類型與因應，最後提出建言。

Even entering Internet Era, the crimes of fraud are not only exiting but also do well in   internet-trading. They are therefore connection with the protection of consumer. In this article, the author analyzes the role of criminal law and protection of consumer in the beginning. There is no criminal code in the Protection of Consumer Act in Taiwan so far. But only some complementary codes accompany the protection of Food, drug and fair trade with. Relatively, the penal codes play more important role to protecting consumers in Japan than in Taiwan. That would be a reference. Secondly, the author illustrates the crimes of Fraud on internet. There are two types of frauds, including internet trade and internet payment. The methods of fraud are told separately. Finally, the suggestions.
