擺盪於「農業保障」與「綠能發展」衝突的法學困境與解決策略思考

Legal Difficulties and Solutions to the Conflict Between “Agricultural Security” and “Green Energy Development”

我國為推動再生能源發展，無論是基於溫室氣體減量、抑制PM2.5的污染，或者達成非核家園目標等不同目的，如何利用太陽能進行發電，成為重要的政策目標。我國「再生能源發展條例」，鼓勵合法建築物之屋頂，得附屬設置太陽能光電發電設備，嗣後行政院農業委員會，配合國家再生能源政策之方向，發布「申請農業用地作農業設施容許使用審查辦法」，增列第九章綠能設施的規定。但是，卻忽略了科技發展下，實踐的過程中，所引發法律爭議有待解決。是以，如何調適「農業保障」與「綠能發展」二者間規範的價值衝突，法律有必要進行整合協調。

Whether it is for the purpose of reducing of the pollution of PM2.5 or reaching the goal of non-nuclear homeland, using solar energy to generate electricity has become an important policy goal in our country so as to promote the development of renewable energy. The “Act of Renewable Energy Development” in our country advocates the roofs of legal structures equipped with solar photovoltaic power generation equipment. Subsequently, the Agriculture Commission of the Executive Yuan, following the national renewable energy policy, issued the “Regulations on the Permission to Use Agricultural Land for Agricultural Facilities” and added Chapter IX of green energy facilities. However, the development of technology ignored, many legal disputes have been triggered in the process of practice. The conflict in legal norms between “agricultural security” and “green energy development” must be resolved. Thus, it is necessary for the law to integrate and coordinate the two.
