美國學者絡徳睦教授的大著《法律東方主義：中國、美國與現代法》，通過對公司/家族法、治外法權與排華法案、駐華法院與會審公廨等論題的深入解析，展現並反思法律東方主義的生成、發展及其背後的動因。西方人眼中的東方（包括中國在內）常常來自於他們的東方主義“塑造”，並由於其塑造的特殊目的以及中西文化間的巨幅鴻溝，塑造出來的產品千差萬別甚而相互抵牾。法律東方主義不僅是西方人的傾向，也深刻影響著百年來中國人的思維和行動方式，在學術研究及制度實踐上均呈現出“自我東方主義”與“自我殖民”的現象。研究中國傳統法律以及進行中西法律比較，走出東方主義與自我東方主義是當務之急，須得首先在態度上拋開這些主義和偏見，其次在學術上以“入乎其內”為前提與基礎，以“出乎其外”為進階與指歸。

Legal Orientalism written by Teemu Ruskola showed us how and why the legal orientalism born and develop by introducing some important topics including company/ family law, extraterritoriality/ Chinese Exclusion Act, etc. Legal orientalism is not only the west people’s inclination, but also influence Chinese people’s thinking and action during the past one hundred years. The most critical thing to do in studying traditional Chinese law and comparative law is to abandon legal orientalism and explore in depth.
