Special Guard Service is the responsibility of National Security Agency. In our country, it always put a layer of mystery, not easy for outsiders to see through. Special Guard Service refers to ensuring the safety of current and former national leaders (such as the President, past Presidents, Vice Presidents, presidential candidates, etc.) and their families. Personnel to enforce the Special Guard Service is pluralism, including the police officer, military and civil servant. Among the attendant personnel, the dispatch of police officer is majority. The enactment of Special Guard Service Act on january 4th, 2012 provide a legal basis for enforcing the special guard service which is long challenged by public for its lack of law enforcement basis, but the leagal controversy is not ended. This paper attempts from the legal side to analysing of Special Guard Service Act section 12 paragraph 1 and the relevant provisions of its Enforcement Rules; the practiacl side to compare the similar properties of Special Guard Service with Police Power, with hope of helping the development of relevant legal thinking, amendment of regulations, and the general elevation of the legal research of Special Guard Service. |
