立法、監察二院調查權爭議之再探

The Study on Explore the Dispute of Investigation Power between Legislative Power and Control Power

本文嘗試由監察院之定位、職權性質等觀點，探討其與立法院於行使調查權時所可能產生之互動與應有之分際。首先，本文認為修憲前之監察院，應非如大法官釋字第76號解釋所言，具有民主國家國會之地位。至於修憲後之監察院職權，性質上應相當於行政權之功能範疇。再者，在調查權爭議部分，本文認為立法院及監察院為行使由憲法所賦予之職權，各自本即得行使不同性質與內容之調查權。此等僅為輔助、依附性之調查權，本身並不會互生衝突，毋寧係其所依附之立法院與監察院職權、功能有生衝突之可能。而此乃係肇因於憲法相關規定將民主國家國會行使之職權與功能，割裂而分由立法院及監察院行使所致。為避免此等衝突之出現，本文除建議應明確詮釋憲法所定關於立法院及監察院職權之規定外，更應制定法規範以作為其各自行使調查權之依據。

This essay is intended to provide insights into the nature or purpose, powers and authorities of the Control Yuan; and moreover, the inter-governmental relations with the Legislative Yuan’s. Unlike J.Y. Interpretation no. 76 states that, the Control Yuan until a series of constitutional reform was considered as equivalent to the parliaments of democratic nations. The powers and authorities, insofar as it ought to belong to the scope of the executive power. Concerning the investigation power, we argue that the Legislative Yuan and the Control Yuan exercise the investigative powers in terms of their respective nature, which is conferred by the Constitution. The investigation power is a subsidiary power, by itself does not conflict with each other, the reason for conflict could be on the basis of the powers and authorities of Yuans that are divided by the Constitution. In case of any controversy between two parliaments of democratic nations in relation to the investigation power, the objective of this essay is to provide suggestion for interpreting the powers and authorities of Yuans in accordance with the Constitution as well as to develop the legal norms.
