Seventy-year Entanglement between Mediation and Judgment: An Analysis Report on the Academic Research of Relationship between Mediation and Judgment

如何正確處理訴訟調解與司法裁判的關係，一直是學術界與實務界共同面對的一個重大難題。本報告在調取和分析1943—2013年有關調判關係的重要研究文獻的基礎上，對調判關係理論研究領域的新情況新問題進行了梳理，提出了今後實現理論創新的突破方向和改善措施。整體上看，這個時期有關研究取得了豐富的學術成果，呈現出十分活躍繁榮的學術景象，但是，也形成了一些重大理論爭點，在一定程度上還存在著“學術與實務兩張皮，實踐與理論相脫離”的實際問題。調判關係問題研究是中國特色社會主義司法制度建設的一個核心課題。加強這個課題的理論研究，改善科研管理，進一步總結和提煉“調判結合”正反兩方面的實踐經驗，深入探索新的歷史條件下訴訟運行規律，從理念論、本質論、價值論、程式論、方法論、目的論、功能論和主體論等八個方向突破思想障礙，實現調判關係理論認識的新飛躍。

How to handle the relationship between mediation and judgment has always been a significant problem puzzling both the theoretical and the practical field. Based on the retrieval and analysis of important research materials about the relationship between mediation and judgment from 1943 to 2013, this report classifies the new situation and new issues in the research area of the relationship between mediation and judgment, proposes the breakthrough direction of innovation and the improvement measures in the future. It’s deduced that abundant research findings the academic prosperity formed during this era, however, significant theoretical disputes also formed in this era and the problem about the “theory separates from the practice” still exists to some extent. The research about the relationship between mediation and judgment is a core subject of the Judicial System in Chinese Characteristic Socialism. It’s necessary to strengthen the theoretical research about this subject, improve the research management, further refine the positive and negative experience from the combination between mediation and judgment, explore the operating rule in new historical circumstance, break through the theoretical impediment from eight directions (ideal, nature, value, procedure, method, target, function, subject) and achieve the leap of the theoretical cognition on the relationship between mediation and trial.
