事先、自由意志下的知情同意,是2007年聯合國通過之『原住民族權利宣言』中所揭葉的重要原則,本文運用文獻回顧與個案研究的方法,以紐西蘭毛利人的經驗為例,探討諮商同意主體的建構過程,以及諮商同意權在自然資源管理上的落實方式,期作為反思台灣原住民族土地權之參考。
FPIC (free, prior and informed consent) is an important principle in the United Nations Declaration on the Rights of Indigenous Peoples in 2007. This article takes the experience of the Maori people in New Zealand as an example to discuss the construction process of the subject of consultation and consent, and the implementation of the right of consultation and consent in the management of natural resources, as a reference for rethinking the land rights of Taiwan's indigenous people. |
