According to types of law, modern Russian law belongs to the German law branch of the Romano and Germanic legal family in civil law system. A code of written law with rigorous structures, strict logic and inclusiveness is the ultimate goal for the lawmakers to pursue. And there is no exception for intellectual property legislation. It is a tradition for Russian civil legislation to incorporate intellectual property law into civil code with an view to unifying provisions. By reviewing the historical progress and legislation background of the codification of Russian intellectual property legislation and comparing and analyzing Russian 'Four Solutions' and Chinese 'Four Patterns', the article aims to figure out the internal relations between Russian intellectual property legislation and civil code compilation as well as the external reasons for the codification of Russian intellectual property, hoping to provide China with a good reference for the choice of intellectual property legislation mode and civil code compilation. |
