China is one of the countries in the wor1d facing the most serious aging problem. The huge number of elders has put enormous pressure on our government, society and families. However, regulations of the elderly guardianship or care in Chinese civil law system are quite immature. This paper intends to discuss the defects and shortage of our current guardianship legal practice with a focus on the more fragile group among the elders, the disabled elders, thus contribute to the legal reform of our future system, in particular, the legislation of our civil code by way of comparative analysis to the counterparts of other civil law countries. |
