社區性刑罰的立法與短期監禁刑問題的解決

Legislative Future of the Community Penalties in China

隨著短期監禁犯數量的上升，短期監禁犯症狀在我國監獄管理工作中日益突顯。短期監禁犯症狀的蔓延，不僅加重國家管理監獄的負擔，而且使得重新犯罪率上升。制定社區性刑罰是國際社會解決短期監禁犯症狀成功的探索。鑒於我國刑罰體系存在的功能性不足，不能充分應對短期監禁犯症狀所帶來的問題，應當考慮制定社區性刑罰。我國可以從設立社區勞動刑入手，先規定社區性刑罰中的社區刑罰，然後規定半監禁刑。

With the number of the short-term prisoners increasing, the issues for the short-term prisoners make prison management sluggish. The issues for the short-term prisoners not only aggravate the prison management efficiency, but also make recidivism ascending. It's successful exploration to solve the problems for short­term prisoners through enacting the community penalties. Considering the functional deficiency of the penalties system that are short of capabilities to face challenges from the short-term prisoners, China should enact the community penalties to improve our punishment system. We could enact the community service, then make the semi-custodial penaty.
