論我國非常法定夫妻財產制的立法建構

On the Legislative Construction of China’s Special Statutory Conjugal Property System

非常法定夫妻財產制為法定夫妻財產制的形態之一，其立法目的在於保護夫妻各方的財產權益和保障家庭扶養職能的履行，同時維護交易安全與第三人利益。值此我國“民法典婚姻家庭編”編纂之際，基於非常法定夫妻財產制的立法功能與立法價值，為滿足我國部分夫妻在婚姻期間因特殊情況對實行非常法定夫妻財產制的需要，建議借鑒大陸法系國家和我國臺灣地區立法經驗，從我國實際出發，在“民法典婚姻家庭編”中設立非常法定夫妻財產制。

As a constituent part of the statutory conjugal property system, the special statutory conjugal property system, which aims to protect property rights and interests of spouse, ensure the implementation of family support function, maintain transaction security and third party interests. On the occasion of codification of Marriage and Family Volume in Civil Code of China, for the purpose of the legislative function and value of special statutory conjugal property system, in order to meet the need of some Chinese couples who want to carry out the special statutory conjugal property system due to special reasons, it is necessary to establish special stat­utory conjugal property system in the Marriage and Family Volume in Civil Code of China on the basis of foreign legislation and the actual conditions of China.
