民法典婚姻家庭編親屬關係通則立法研究

Legislative Study on General Rule of Kinship in the Part of Marriage and Family in the Civil Code

我國現行《婚姻法》對親屬制度的一般性規則未作明確系統的規定，這與我國婚姻法長期以來的立法目的與法律存在形式有著深刻的關係。在民法法典化過程中，在婚姻家庭編中增設親屬關係通則，既是在法律形式上實現體系化的必然選擇，也是達成法律內部邏輯完整性的基本要求。我國親屬關係通則的制度構建離不開對親屬倫理的認識和對現實問題的回應。在宏觀審視制度架構及主要內容基礎上，對親等的計算方法、近親屬範圍的確定等主要爭議問題提出觀點和看法。

China's present marriage law has no clear and systematic stipulation on the general rule of kinsfolk system, which is closely linked to the legislative aims and existence form of marriage law for a long time. In the process of the codification of civil law, adding the general rule of kinship in marriage law is not only a certain choice to realize the systemization of legal form, but also a basic requirement for the law's internal integrity of logic. The structure of China's general rule of kinship system cannot be built without the perception of kinsfolk ethics and the response to realistic problems. This article first took a macroscopic view of the institutional framework and the basic contents, and then discussed several major controversial issues such as the reckoning method of degree of relationship and the determination of the range of close relatives.
