反亞泥還我土地運動：回顧與展望

The Movement of Fighting against AsiaCement Corporation and Returning OurLands: Retrospect and Prospect in 2018

因應『礦業法部分條文修正草案』即可能於107 年由立法院審議通過，本文將於介紹「反亞泥還我土地運動」四十餘年的脈絡為背景以及「原住民保留地」制度後，分析亞洲水泥租用礦場內之原住民保留地，是否確實合乎法令規範？並以多項歷史文件進行核對與佐證。此後再進一步介紹本次「礦業法修正草案」重點，並探討若修法通過後，對於亞泥以及合法取得原住民保留地之耕作權或所有權的族人，將有何影響？是否可能恢復土地使用？抑或有其他發展可能？

First, in response to the Draft Amendments to the Mining Act whichmay be examined and approved by the Legislative Yuan in 2018, this articlewill introduce the history of “Movement of Fighting against Asia CementCorporation and Returning Our Lands” and the institution of “LandsReserved for Indigenous People” in Taiwan. After that, this article willanalyze whether the Asia Cement Corporation leased the “Lands Reservedfor Indigenous People” legally through several historical documents.Second, the key point of the Draft Amendments to the Mining Act will beintroduced. This article will also discuss what influence is going to occur toAsia Cement Corporation and the aboriginal people who have tillage rightsand ownership if the draft amendment is approved, will the aboriginal peopleuse their lands again? Or there are some other possibilities?
