海外遊學組團人數不足解除契約所涉定型化契約條款競合賠償爭議之探討

海外旅遊學習主要以體驗新鮮事物、增廣見聞為多數，再者作為海外交流學習之不同生活體驗，亦對於親子關係培養與情感建立至為重要，如果業者因為規劃不周導致不能成行，將造成學生與家長方之損失，讓暑假期間原先期待落空，無法合理有效運用。依據教育部「海外旅遊學習定型化契約範本」，旅遊學習主辦業者如因人數不足約定不能成行，僅於預定出發之七日前通知消費者得解除契約，即可以不必負擔任何損害賠償責任，殊有可議。為此，本文從消費者保護法制觀點研究建議：海外旅遊學習定型化契約，宜全部回歸以第16條作為對於業者違約之處罰，包含人數不足及規定最低出團人數標準（最高人數不超過十五人已有規定）之罰則，避免業者動輒以此解除契約之藉口，期以完善保護消費者權益。
