In The Condominium Administration Act Building Administration Division Article 5: “When using their individual unit, unit owners may not engage in any practice that is impairing the proper use of the building or violating the common interests of all unit owners.” Whether the breach of common interest, not only from the side of the property management, should live together from the side, or even agree with the side to be involved in considerations. This paper attempts to analyze and summarize “violations of common interests” this uncertain legal connotation of the concept and to establish their behavior types and criterion. As regards the legal effect of “violations of common interests”, although included: a variety of administrative responsibility and civil liability, or even forced evictions, forced to sell or auction the right to exercise a high degree of restriction of behavior, then paper argues, should be considered on a group of applicable legal principles such as the principle of proportionality and necessity. |
