The Guarantee Responsibility of the State for Power Supply

本文以探討國家在電力供應領域民營化以及自由化後所應負之擔保責任為研究對象。首先將探究國家責任，尤其是國家擔保責任之理論基礎、其在電力供應領域所可能出現而與此一任務相契合之責任內涵與類型，以及在此領域中具體落實之方式。繼之，即分析我國電力能源之供應結構，並探究現行政府相關部門所欲推行整體電力市場自由化之方案內容，再由國家擔保責任理論檢視其妥適性以及應修正之處。

The study investigates that the country incumbent on the guarantee obligations to the privatization and the liberalization of the power supply. First point focuses on the state responsibility; particularly the theoretical basis of national security responsibility and the exploration of the potential responsibility and types which are associated with this task in electricity supply, and the practical implementation. Then, the article will analyze the structure of the power supply and to research the schemes and the differences for the privatization of Taipower Company and the liberation of electricity market provided by the existing relevant government departments and the private sectors. In the process, it organizes the future structure and the development trend in electricity market and then the theoretical basis of national security responsibility reviews its appropriateness and amends.
