Faced with the debate about the definition and strategy of the indigenous transitional justice, this article emphasized a perspective from ethnic mainstreaming. Ethnic Mainstreaming requires the government at all levels to have basic ethnic sensitivity and to raise the public awareness of that everyone is part of the ethnic relations, and then all ethnic groups would be able to participate in construction of the mainstream society. The indigenous issue is a special and significant part in transitional justice in the Taiwanese context. The present article assessed three indigenous transitional justice programs from the point of view of the ethnic mainstreaming to see if the merged legislation of indigenous transitional justice and authoritarian transitional justice could effectively achieve social reconciliation and democratic consolidations. On the contrary, if separating or even not making legislation for indigenous transitional justice will require more social consensus in order to bring reconciliation. It is incompatible with the general awareness of the transitional justice to consider the implementation of the Indigenous Peoples Basic Law being equivalent to the implementation of the indigenous transitional justice. |
