On the Positive Confirmation of Personality Right-- The Relationship of Personality Right Law and Tort Liability Law

如何處理人格權與侵權法之間的關係，是我國民法典制定需要解決的前置性問題。對人格權從消極保護向積極保護、從司法確權向立法確權轉變，是當代民法發展的重要趨勢。人格權法與侵權法在民法典中分別具有不同的功能，人格權法獨立成編不會弱化侵權法的功能。如果體系與內容設計得當，人格權法還可與侵權法相互補充、相得益彰。

How to handle the relationship of personality right law and tort liability law is a prerequisite issue for the drafting of civil code. It's a significant tendency of contemporary civil law development that protection of personality right transfers from negative model to positive model and from judicial confirmation to legislative confirmation. Personality right law and tort liability law play different roles in the civil code. The independence in form of personality right law in the civil code will not weaken the function of tort liability law. Designed properly in systematic structure and content, independent personality right law and tort liability law will fulfill their function respectively with mutually complementary effect.
