Consensus is consistent with the objective representation of the parties to explain the formation. When the content of representation led to controversy, additional attribution requirements should be added to the party who made the representation and the recipient party as a value basis for determining the consensus. The minimum standard for consensus should be the agreement between both parties which can be recognized by the law, the other terms can be filled by additional explanations and arbitrary norms. 'Mirroring rules' cannot fully meet the needs of the transaction, which needs properly corrected. The nature of the contract should be identified based on its substantive provisions content of Intent or procedural provisions. |
