中國古代的律文解釋與近代的刑法法條解釋之比較－－以《唐律疏議》與《中華民國新刑法判解彙編》為例

The Comparative Study on the Textual Explanation of Ancient China Law and Modern China Criminal Provisions: the Comparison between the Review of Tang Code and The Compilation of New Criminal Law Explanation of The Republic of China

以《唐律疏議》與《中華民國新刑法判解彙編》為例，對中國古代的律文解釋與 近代刑法法條解釋的比較以後可以發現，它們有相似之處，具體表現為：刑法原則、罪名和刑罰等的解釋十分相似。同時，在解釋主體、解釋結構和解釋效力等方面存在相異之處。這些相似、相異之處還有自己形成的原因。形成相似之處的原因主要有兩個，即相似的解釋宗旨、解釋技術。形成相異之處的原因也主要有兩個，即相異的歷史時期、相異的法制。經過這一比較還可以得出這樣的結論：它們的這種解釋都源於中國古代的經學。從中亦可見，中國古代經學影響之深遠。

Taking the Review of Tang Code and The Compilation of New Criminal Law Explanation of The Republic of China as an example, after comparing the textual explanation of ancient China law and the explanation of modern China criminal law, some similarities can be summarized as the follows: the explanation of the principle of criminal law, the name of the crime and the penalty resemble a lot. While the subject of explanation, the explanation structure and the effectiveness of the explanation differ a lot. Both the similarities and differences have their own reasons. The reason for similarities is the explanation principle and techniques, while the reason for differences is the different historical period and legal systems. From the comparison, we can see that both explanations derive from the study of ancient China Classics, which has profound influence in Chinese history.
