對現行審級制度的反思與重構，必須建立在深入考察其形成和發展的歷史背景基礎之上。審判監督程序對審級制度的影響絕非僅僅在於其“補充”意義，隨時代發展已經起到了嚴重侵蝕和瓦解的作用。新的審級制度的建構不僅需要適當的技術原理，還必須以新的正當性資源為基礎。

The introspection and reconstruction of the current civil trial system must be established on the basis of thorough inspection of the historical context of its formulation and development. The impact of trial supervising procedure to civil trial system is not only “adding”, and it has deteriorated to the impact of serious eroding and disintegrating. In order to establish a new trial level system, it not only needs a proper technical principle, but also depends on the basis of new appropriate resources.
