房屋承租人優先購買權制度之反思

無論怎樣構建房屋承租人行使優先購買權的合理模式，都無法克服阻礙商品流通、侵害出租人和第三人利益、額外優惠承租人、出租人與第三人勾結使優先保護承租人的規定流為具文等弊端；因此應當廢除此制度。取而代之的是承租人先行購買、承租人與第三人不同時出現的新的制度。

No matter how hard we set up the reasonable mode of Leased house renter’s exertion initiative to purchase, it can’t overcome the problems such as baffling merchandise to circulate, infringement upon interests of lessor and the third people, extra favor to renter. Therefore this system should be abolished, the substitute is a new system which entitles the renter to purchases Leased house in advance, and avoids the renter and the third people appear at one time.
