Genetic testing can identify “defective genes”linked to genetic diseases. Since one shares genes with blood relatives, the same defective gene may also appear in relatives. A conflict of interest occurs if patient refused to disclose the genetic Information to relatives to help them prevent genetic diseases. There is a hot debate on whether a physician should be subject to a duty to warn relatives or enjoy a privilege to warn. By reviewing cases involving violent patients, contagious diseases and HIV, and analyzing torts law, this thesis concluded that physicians are under no duty to warn relatives, nor suitable to have privilege to warn, because the extreme complexity of genetic diseases and psychological impact on relatives are far beyond what a physician can deal with. A special committee should be established to be responsible for determining whether to warn, locating the relatives and delivering warning with necessary genetic counseling. |
