民法法典化及其限制

中國民法典的制定是歷史擺在我們面前的課題。帶著這個問題，文章考察了民法法典化的內在品質及其缺陷、古典法學中法典化成就及其學米背景、現代法學中法典化危機和制約民法典制定的因素。通過這些考察，文章認為當前我國民法典制定工作缺乏應有的學術背景和相應的政治、經濟和文化環境；因此，要想制定出一部2 1 世紀民法典，我們還需要對相關問題進行更深入地研究。

Codification of Chinese Civil Law is the task we have to take on. Centering on this topic, the article investigates the inner natures and limitations of its codification, the achievements of codification in ancient law and its academic basis, the crisis of codification in modern law and its conditions. Then it points out that there is no suitable academic basis and social environments for the codification of Chinese Civil Law at the present. It thus draws the conclusion that we must first make a thorough study on relative themes in Order to complete the code for Century 21.
