Real and false labor dispatch or inappropriate labor dispatch is an important dimension in the study of legal system regarding labor dispatch. Labor dispatch, as a special employment approach, is contracted between dispatching unit and laborer. However, it is rarely mentioned in the Labor Contract Law of PRC. In reality, it is common to see that the employer’s excessive intervention into the contracting process, and further in theory, there are few discussions focusing on the scale or degree of its intervention into the process. Following the general principles of the labor contract system, it is necessary to introduce the authentic employer judgment standard into the labor dispatch contract, in which we should not only admit the employer’s involvement into the labor dispatch contracting process from the economic rationality, but also limit its excessive intervention of the concerning employer. In conclusion, the introduction of authentic employer standard into the process of labor dispatch contracting will be a significant approach in regulating labor dispatch of our country. |
