寵物殯葬設施管理制度建構之研究

A Study on the Institutional Establishment of Pet Funeral Facilities Management

我國寵物殯葬需求逐年攀升，然而對於相關產業的管理，卻沒有一個一體適用或符合飼主期待的法源。因而致使相關業者只得違法經營，既不利於環境衛生與公共利益之維護，倘若發生飼主與業者之間的糾紛等情事，將可能發生無法可管之窘境。因此，建構一個周延可行的寵物殯葬管理制度是重要的課題。本研究依循殯葬制度變遷的概念，採文獻分析與焦點團體訪談法，以此建構寵物殯葬管理設施制度的討論與分析。經本研究實證分析後發現：管理機關宜隸屬為農政單位（機關）主管；立法體例應採獨立專法較為妥適；至於寵物殯葬設施專法之法律位階，短期內可因地制宜，由各地方縣市政府視需求訂定自治條例。長期而言，必須由中央立法訂定全國統一性的管理法律較為妥適。

The demand of pet funeral rises gradually year by year in Taiwan. However, there is no law that is suitable for the management of relevant industry and pet owners. It results in illegal operation among all pet funeral industries. It is not only harmful to the environmental sanitation and maintenance of public benefits, but also causes no law to cope with disputes between pet funeral industries and pet owners. Therefore, to establish cautious and practical pet funeral management institutions is an important topic. This study follows the perception of institutional transition, adopting secondary data analysis method and focused group interview method, for this reason to have relevant discussion and analysis. This study discovers that the main governance authority should be subordinate to agricultural authorities; legislation style should adopt independent special bill. As to the legal hierarchy towards special bill of pet funeral facilities, it can take appropriate actions in the short-term to meet the needs of each county or municipality to legislate self-government bill. In the long-term, it is suitable and needed for central authorities to legislate nation-wide unity bill.
