This paper employs competing models to validate the relationships among a mutual understanding, a market’s competition ability, and a legal effect on cartel, to explain the gap between the regulations of article 7 of Taiwan Fair Trade Law and the effect doctrine of legal area. The study is a crossing area research, it integrated the research spirit of managerial domain, and different from previous related documents of competitive law, which were concerned only with law relationships. A research sample of 116 cases, from 2000 to 2010, is sourced from the Taiwan Fair Trade Commission, and statistical analysis is conducted for validation. The results confirm that the most fitness model is a full mediated model (F-M-M), the market’s competition ability occupies full mediated effect, and the regulations of the article 7 of Taiwan Fair Trade Law are supported. Also, the significantly explanatory capabilities are validated by the relationships between the legal effect and the other variables. The findings can provide references to an authority of competition law and a business for handling similar cases. |
