尊重、保護和給付三層次性的國家義務結構論已為社會各界所廣泛認同,而在有關受教育權的國家義務理論中,唯獨受教育權的國家給付義務卻很少被人論及,且其法律規制現狀也比較紊亂。所以,對這一領域空缺的充實與完善實有必要。從受教育權得到充分保障的角度來看,其國家給付義務的內容體系建構對履行行為的監督機制是兩大關鍵性問題。前者主要包括物質性付、服務性給付和制度性給付三個方面;后者分為國家義務機關自行糾錯、公民監督權的行使和公力救濟三種途徑。There levels of state obligation structures, respect, protection and provision, have been widely recognized by the society. However, the state provision oblgation of the right to education has rarely been ad-dressed in state obligations theory relating to the right to education, and also its legal regulation slatus is rela-tively in disorder. Therefore. it is necessary to fill this vacancy and perfect it . Fron the perspective of fully protecting the right to education , the content construction and supervision mechanism of the state provision obli-gation are two key issues. The formr mainly includes three aspects which are material provisons, service provi-sions and institutional provisions. While the latter consists of the self-correction of government organs, eivil rights to supervision and public remedies. |
