對意思形成階段上錯誤在一定條件下也應予以救濟，已為國際間共識，差別僅在於是否統合在錯誤法則中處理，或如德國民法發展出法律行為基礎理論另闢蹊徑解決。我國民法錯誤法則適用對象侷限在表達階段上錯誤（表示行為錯誤、內容錯誤、傳達錯誤），雖非立法者首創，而為德國立法例之繼受，但卻未繼受德國法律行為基礎理論或自己開發出對意思形成階段上救濟之制度，我國錯誤法則左支右絀、捉襟見肘。契約錯誤之比較法考察。

The idea that not only the mistakes in expression, but also the mistakes in motive are under certain conditions operative has gradually become one of the common accepted principles in the law of mistakes.
